We guarantee our products to be free from defects due to faulty workmanship or materials and back that with a twelve (12) month LIMITED WARRANTY.
For a period of twelve months from the date of purchase from an authorized PurePail retailer, any product found to have defects will be replaced or repaired (at our option) and at no cost to you.
This warranty extends only to the original retail purchaser and is valid only when supplied with proof of purchase such as an original sales receipt.
The limited warranty does not cover or apply to:
Damage that is the result of improper storage, installation, negligence or misuse. Products that have been misused, neglected, altered or modified in any way. Products with stains caused by grease, inks, cosmetics, bleach, alcohol, dyes, solvents, corrosives. Damage, not caused by the manufacturer, which penetrates the material. Products bought as used or secondhand products, including items that served as floor models, samples, final or liquidation. Products that do not have the manufacturer’s original law tags and/or warning labels. Normal wear and tear. Commercial use. Where warranty requirements vary by law, local codes apply.
THE GUARANTEE STATED ABOVE IS IN LIEU OF ALL OTHER WARRANTIES, CONDITIONS OR OTHER TERMS, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF TERMS AS TO QUALITY, FITNESS FOR ANY PARTICULAR PURPOSE, MERCHANTABILITY OR OTHERWISE, WHETHER IMPLIED BY CUSTOM OR LAW.
IN NO EVENT SHALL WE BE LIABLE TO ANYONE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES OF ANY KIND OR NATURE ARISING OUT OF OR RELATING TO THIS GUARANTEE OR CONNECTED WITH OR RESULTING FROM THE MANUFACTURE, SALE, DELIVERY, RESALE, REPAIR, REPLACEMENT, OR USE OF ANY PRODUCTS OR THE FURNISHING OF ANY SERVICE OR PART THEREOF, WHETHER SUCH LIABILITY IS BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF WE HAVE BEEN WARNED OF THE POSSIBILITY OF ANY SUCH DAMAGES.
